We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site or commissioning a sculpture from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms apply to all users of the site, including browsers, designers, architects, and trade partners.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our bespoke products for any illegal or unauthorized purpose.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your project data (excluding credit card information) may be transferred unencrypted to facilitate production with our artisans and technicians.

SECTION 3 - ACCURACY OF INFORMATION

While we strive for perfection in our gallery, we are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general inspiration and should not be relied upon as the sole basis for architectural decisions without consulting our specialists.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our custom sculptures are subject to change without notice. Due to the fluctuating costs of raw materials (such as marine-grade stainless steel, bronze, and marble), formal quotes are typically valid for a limited period as specified in the quotation.

SECTION 5 - BESPOKE PRODUCTS OR SERVICES

Certain products may be available exclusively through our website. As we specialize in custom-sized and made-to-order sculptures, these items are non-returnable and non-refundable once production has commenced.

We have made every effort to display as accurately as possible the textures and colors of our materials. However, natural materials like marble and hand-applied patinas on bronze will have unique variations that are considered part of the artwork's character.

SECTION 6 - BILLING AND ACCOUNT ACCURACY

We reserve the right to refuse any order. For custom commissions, we require accurate billing and contact information to ensure successful coordination with architectural sites and logistics providers.

SECTION 7 - THIRD-PARTY LINKS & TOOLS

We may provide access to third-party tools (such as AR viewers or material calculators). Use of these is at your own risk. Links to third-party architectural or design platforms are not under our control.

SECTION 8 - INTELLECTUAL PROPERTY

The designs, concepts, and 3D renders provided by VELA SCULPTURE remain the intellectual property of our brand. Unauthorized reproduction or duplication of our artistic works is strictly prohibited.

SECTION 9 - ERRORS AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors or omissions relating to material availability or shipping transit times. We reserve the right to correct any errors and cancel orders if any information is inaccurate.

SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

VELA SCULPTURE does not warrant that your use of the service will be uninterrupted or error-free. In no case shall VELA SCULPTURE be liable for any injury, loss, or damages arising from the use or installation of our sculptures, which must be handled by professional contractors.

SECTION 11 - INDEMNIFICATION

You agree to indemnify and hold harmless VELA SCULPTURE and our partners from any claim made by any third-party due to your breach of these Terms of Service.

SECTION 12 - GOVERNING LAW

All purchases and commissions are governed by the laws of the United States (and the jurisdiction of our primary business registration), unless otherwise specified in your formal contract.

SECTION 13 - FORCE MAJEURE

Neither party shall be liable for any delay in performance (excluding payment) due to causes beyond reasonable control, including but not limited to: natural disasters, pandemics, port congestion, customs delays, or shortages of raw materials. If a Force Majeure Event continues for more than thirty (30) days, both parties will discuss reasonable alternatives for project completion.
